Bartow DUI – Fair is Fair No Matter Who You Are

It might seem that a news item coming out of Seattle Washington has very little to do with residents of Bartow, FL. But actually, this news item stresses the point that no resident of Bartow should ever forget. A DUI arrest does not equal DUI guilt. The prosecutor may be able to press other charges, but DUI attorneys have long recognized that a DUI arrest must be backed up with solid evidence.

The news item we’re referring to is an event that happened early in 2010. The young man made famous by the Discovery Channel’s “Deadliest Catch” reality show was arrested nine days after his father, Phil Harris, died of a stroke. Jake was charged with DUI and hit-and-run.

Of course, this arrest was an immediate media sensation. Jake Harris had publicly admitted his struggle with drugs on the program, so of course there was much discussion over whether he had been driving while under the influence of alcohol.

By the end of March, the King County Prosecutor realized he could not prove that Jake had been under the influence at the time of the offense. Nor could they prove the hit-and-run charges. The King County prosecutor’s office had to reduce his charges to reckless driving and driving with a suspended license.

Meanwhile a lot of discussion was going on in blogs across the country. Should Jake be given a break because he had been under so much stress from losing his father? Some said yes. Father said no (wasn’t his father dead?). The reality is that if there had been evidence to prove that he was drinking and driving, DUI charges would have been pressed. There just was not enough evidence to support the arresting officer’s assumptions.

That is what a good DUI attorney works for. Many DUI arrests are based on suspicion without any supporting evidence. Wrong conclusions are drawn from a driver’s behavior. At times like this, it is important to contact a DUI attorney who understands the mechanics of DUI defense thoroughly.
